Your use of this site is governed by the following Terms and Conditions. Specifically, you acknowledge that Weekendtrips.com, Inc. (the "Company"):
* is not a vendor or supplier of any of the travel or other services, or products, referred to in this site;
* makes no representation, express or implied, with respect to the products or services referred to in, nor the vendors or suppliers accessible through, this website, and;
* is not responsible for the provision of any features of any of such products or services, or the accuracy of any description of them.
If you do not agree with any component of these Terms and Conditions, you may not use this website. In the event that, notwithstanding the foregoing, the company is ultimately found to be liable for the products or services referred to in, or the acts or omissions of the vendors or suppliers accessible through, this website, then the damages resulting therefrom shall not exceed the greater of:
(A)the amount of any subscription fee actually paid to the Company in return for access to this website and
(B) CAD$50.00.
Prices, reservations and payment
Any and all purchases of travel or other services that you make as a result of your use of this site are governed by the terms and conditions agreed upon by you (as purchaser) and the vendor or supplier of those services (as vendor). This includes the price to be paid, the terms and method of payment, the ways in which bookings are to be effected, any applicable eligibility requirements, optional or mandatory insurance, and cancellation provisions. The Company is not a party to any contract by which you acquire travel or other services.
A Note About Pictures
The images featured on the Company's website are for general reference only. The Company makes no representation as to their accuracy or their applicability to the products or services being described. They are instead intended to provide a sense of the scenery, experience and facilities that might be available. The images featured on the website of any vendor or supplier which is accessed via the Company's site are the responsibility of that vendor or supplier, and not the Company."
Responsibility
None of the Company, its affiliates, its associates, and its officers, directors, staff and employees (the "Beneficiaries") shall be responsible for any claim, injury, loss or damages of any sort or kind (including any damage to property or to health) which may be sustained by reason of your use of this website unless the sole and exclusive cause of such claim, injury, loss or damage is the intentional or the negligent act or omission of the Company. Notwithstanding the foregoing, none of the Beneficiaries shall be responsible for the description, the delivery, the quality or any other component or aspect of any product or service described in, or accessible via, this website.
Complaints and Claims
In the event of a complaint against any of the Beneficiaries, it must be submitted in writing to the Company within seven (7) days after you first become aware of the basis of such complaint, failing which it shall be invalid. Any legal action against any of the Beneficiaries must be brought in the city of Toronto, Canada, and you agree to attorn to the exclusive jurisdiction of, and to the applicability of the laws of, the Province of Ontario and the laws of Canada applicable therein."
